1. Assumption of Risk and Waiver of Liability
a. Thermal Pane Fogging or Moisture Between Panes
SonnyWindows is not liable for moisture or water intrusion between insulated panes (double- or triple-pane). This condition results from failed window seals, which are pre-existing manufacturing or wear-related defects outside our control.
b. Pre-Existing Damage
SonnyWindows is not responsible for pre-existing damage to windows, screens, frames, sills, tracks, paint, landscaping, or structures. Examples include cracked or chipped glass, loose frames, oxidized screens, rotted wood, failing seals, or brittle caulking.
c. Surfaces and Materials
Some surfaces may be susceptible to scratching, wear, or deterioration due to prior damage, improper installation, age, or incompatible materials. SonnyWindows is not liable for issues arising from these conditions.
d. Dislodged Window Panes During Regular Cleaning
Older or improperly installed windows may have loose panes not visible prior to service. If a pane becomes dislodged or falls out during standard cleaning, SonnyWindows is not liable.
e. Interior Water Intrusion from Leaking Windows
SonnyWindows is not responsible for interior water damage caused by leaking, failed, or improperly sealed windows. Clients are responsible for ensuring windows are properly sealed and maintained.
2. Scope of Work – Interior & Exterior Window Cleaning
a. Standard Service
Standard service includes removal of dirt, dust, and debris from agreed-upon glass surfaces using industry-standard tools and cleaning solutions.
b. Exclusions
Hard water stain removal, overspray scraping, adhesive removal, paint or concrete splatter removal, tree sap removal, and all restoration-level services require separate approval, pricing, and scheduling.
3. Scope of Work – Exterior Recurring Service Plans
a. Standard Service
Exterior recurring service includes removal of dirt, dust, and debris from exterior glass surfaces using standard tools and solutions.
b. Exclusions
Restoration-level services—including hard water removal, adhesive scraping, or construction debris removal—are not included unless explicitly approved in writing.
4. Scope of Work – 365 Spotless Program
a. Program Eligibility & First Application
The 365 Spotless Program is available only after completion of a first-time deep clean to ensure proper surface preparation.
b. Quarterly Service Inclusions
Each quarter, enrolled clients receive:
One (1) Stay-Clean Window and Screen Sealant application on exterior glass and exterior window screens
c. Program Exclusions
The program does not include:
Hard water stain removal
Adhesive or sticker removal
Paint overspray or scraping
Concrete or construction debris removal
Tree sap removal
Any restoration-level service
All excluded services require separate quotes.
d. Stay-Clean Warrenty & Touch-Ups
SonnyWindows guarantees the performance of the water repellent. If failure occurs between quarterly applications, the client is entitled to:
One (1) complimentary touch-up per quarter. This is referred to as our Stay-Clean Warranty
Touch-Up Limitations:
Only one touch-up allowed between scheduled applications
Touch-ups may not be performed within 14 days prior to the next scheduled application
Client must remove and reinstall all window screens
Touch-ups apply to exterior glass only
Touch-ups are limited to 20 window panes
Failure to meet these requirements may result in forfeiture or rescheduling.
e. Client Responsibilities for the 365 Spotless Program
Client agrees to:
Provide access to all exterior windows
Maintain windows, frames, and seals in good repair
Maintain the quarterly service schedule
Failure to comply may void performance guarantees or touch-up eligibility.
f. Program Cancellation Policy
Clients may cancel at any time; however:
Clients must schedule a cancellation interview
No refunds are issued for processed subscription payments
Payments are not prorated
Unused services at time of cancellation are forfeited
Monthly subscription fees cannot be applied to other services
30 days notice before cancellation
g. Billing Cycle & Payment Terms
Billing Start Date
Billing begins on the first day of the month following the initial cleaning.
Monthly Subscription Billing
Charges process on the 1st of each month
Monthly fees fund quarterly services and program benefits
Payments are program fees, not service credits
No Credit or Refund
Monthly subscription charges are non-refundable and non-transferable.
5. Deposits, Recurring Services, and Payment Terms
a. 10% Deposit Requirement
A non-refundable 10% deposit is required to reserve a service date.
b. Deposit Credit Policy
Canceled services may have deposits credited toward future services at SonnyWindows’ discretion.
c. Recurring Service Clients
Clients on recurring plans maintain scheduled visits. Canceled visits are not refunded but may be credited toward future services.
d. Late Fees
Unpaid balances accrue a 10% monthly late fee.
6. Damage Caused by SonnyWindows’ Negligence
If SonnyWindows causes damage due to direct negligence (excluding pre-existing conditions), SonnyWindows will, at its discretion:
Repair the affected item
Provide reasonable compensation
Coordinate insurance coverage
All damage must be reported within 48 hours of service completion.
7. Client Responsibilities
Clients agree to:
Provide clear access to all windows
Secure pets, valuables, and fragile items
Acknowledge that improperly installed tint, seals, or coatings may be affected by cleaning
8. Weather and Safety Conditions
SonnyWindows may delay, reschedule, or cancel services due to unsafe weather or hazardous job-site conditions.
9. Photo & Video Release
By allowing SonnyWindows to perform services, the client grants permission for photographs and videos of work performed to be used for marketing, documentation, or educational purposes without additional consent or compensation.
10. Force Majeure
SonnyWindows is not liable for delays or failure to perform due to events beyond reasonable control, including severe weather, natural disasters, or government restrictions.
11. Limitation of Liability
Except for damages caused by SonnyWindows’ direct negligence, liability shall not exceed the amount paid for the specific service. SonnyWindows is not responsible for indirect, incidental, or consequential damages.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state where services are provided (California or Idaho). Disputes shall first be resolved through good-faith negotiation, then binding arbitration in the service state.
13. Authorization to Perform Services
By scheduling service, the client represents they are the property owner or have full authority to authorize SonnyWindows to perform services and accept these Terms and Conditions on behalf of the property owner.
14. Right to Refuse or Discontinue Service
SonnyWindows reserves the right to refuse, reschedule, or discontinue service at any time if conditions are deemed unsafe, inaccessible, misrepresented, or inconsistent with company standards.
15. Latent or Hidden Defects
SonnyWindows is not responsible for damage caused by latent or hidden defects that were not visible or reasonably discoverable prior to service, including concealed rot, structural failure, loose glass, or internal seal failure.
16. No Guarantee of Results
While SonnyWindows strives for high-quality results, no guarantee is made regarding complete stain removal, long-term cleanliness, or prevention of future buildup. Results may vary due to surface condition, environmental exposure, and prior damage.
17. Payment Disputes and Chargebacks
Clients agree not to initiate chargebacks or payment disputes for services rendered in accordance with these Terms. Billing concerns must be submitted in writing within 7 days of service completion.
18. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede all prior discussions, representations, or agreements, whether written or oral.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Solar Panel Cleaning Terms and Conditions

Assumption of Risk and Waiver of Liability
a. Pre-Existing Panel Damage
SonnyWindows is not liable for damage to solar panels that results from pre-existing conditions, including but not limited to microcracks, delamination, faulty installation, poor electrical connections, manufacturer defects, or age-related deterioration.
b. Panel Mounting and Roof Conditions
SonnyWindows shall not be held responsible for damage caused by insecure or faulty mounting hardware, roof tile breakage, structural weaknesses, or deteriorated roofing materials that cannot support technician access.
c. Water Leaks or Electrical Issues
SonnyWindows uses water-fed poles and deionized water systems considered safe for solar panel cleaning. However, if a panel or system leaks due to poor sealing, compromised conduits, defective gaskets, or improper installation, SonnyWindows is not liable for water intrusion, electrical malfunctions, fire risk, or associated property damage.
d. Non-Standard Panels or Equipment
SonnyWindows is not responsible for issues arising from cleaning non-traditional or specialty systems, including but not limited to hybrid solar-thermal panels, integrated roofing systems, or custom installations, unless such systems are disclosed in advance and approved in writing.
e. Latent or Hidden Defects
SonnyWindows is not responsible for damage caused by latent or hidden defects that were not visible or reasonably discoverable prior to service, including internal panel failures, concealed wiring issues, or hidden roof damage.
Scope of Work
a. Standard Service
Solar panel cleaning consists solely of removing dirt, pollen, bird droppings, environmental residue, and other surface-level debris using purified water and soft-bristle brushes or water-fed poles, in accordance with industry best practices.
b. Exclusions
SonnyWindows does not provide inspection, diagnostics, electrical testing, production monitoring, roof repair, solar system maintenance, panel removal, or restoration services as part of standard cleaning. Aggressive scraping, chemical treatments, or abrasive methods are not used unless explicitly agreed to in writing.
c. Obstructions and Access Issues
Clients are responsible for ensuring safe, unobstructed, and reasonable access to the roof and solar panel areas. If access is unsafe or obstructed due to slope, instability, debris, locked gates, animals, or other hazards, SonnyWindows reserves the right to reschedule, cancel, or discontinue service.
No Guarantee of Performance
SonnyWindows does not guarantee any specific improvement in solar energy output, efficiency, or system performance as a result of cleaning services. Results vary based on factors including panel age, condition, shading, weather, system design, and overall system health.
Deposits, Recurring Services, and Payment Terms
a. 10% Deposit Requirement
A non-refundable 10% deposit is required to schedule solar panel cleaning services.
b. Deposit Credit Policy
Canceled solar services are not refunded; however, the deposit may be credited toward future services at SonnyWindows’ sole discretion.
c. Recurring Service Clients
Clients enrolled in recurring solar panel cleaning plans are billed in advance. If a scheduled service is canceled, the charge may be credited toward a future solar or additional service.
d. Late Fees
Balances unpaid past the due date are subject to a 10% monthly late fee until paid in full.
Damage Caused by SonnyWindows Negligence
In the rare event of direct, provable negligence by SonnyWindows resulting in damage to a solar panel or associated equipment, SonnyWindows will, at its discretion:
Repair or compensate for the damage to restore the item to its pre-loss condition, or
Submit the claim to its insurer, if applicable.
All damage claims must be reported within 48 hours of service completion.
Client Responsibilities
Clients agree to:
Provide clear, safe access to solar panels and surrounding work areas
Ensure roofs, mounts, and structures are capable of supporting technician access
Secure pets and keep all pathways, driveways, and gates accessible
Notify SonnyWindows of any known panel issues, roof concerns, or special instructions prior to service
Failure to disclose relevant conditions may result in denial of liability coverage.
Structural Integrity Disclaimer
Client acknowledges that all roofs, mounting systems, and supporting structures are structurally sound and capable of safely supporting technician access. SonnyWindows is not responsible for structural failures related to age, design flaws, improper construction, or material deterioration.
Authorization to Perform Services
By scheduling service, the client confirms they are the property owner or have full authority to authorize solar panel cleaning and agree to these Terms and Conditions on behalf of the property owner.
Weather and Safety
Services may be delayed, rescheduled, partially completed, or canceled due to weather conditions, wet or slippery surfaces, excessive heat, high winds, or any situation deemed unsafe. SonnyWindows retains sole discretion to determine when service can be safely performed.
Incomplete or Interrupted Services
If service cannot be completed due to safety concerns, weather conditions, access limitations, or undisclosed hazards, SonnyWindows may charge for work performed up to the point of interruption.
Right to Refuse Service
SonnyWindows reserves the right to refuse, discontinue, or terminate service at any time if conditions are deemed unsafe, misleading, or inconsistent with company standards.
Photo and Video Release
By receiving service, the client grants SonnyWindows permission to capture and use photographs or video of the work performed for marketing, documentation, training, or educational purposes, without additional consent or compensation.
Force Majeure
SonnyWindows shall not be held responsible for delays, rescheduling, or failure to perform services due to events beyond its control, including but not limited to natural disasters, storms, fires, power outages, labor shortages, or government restrictions.
Limitation of Liability
SonnyWindows’ total liability is limited to the total amount paid for the specific service in question. Under no circumstances shall SonnyWindows be liable for consequential, incidental, indirect, or special damages, including but not limited to lost energy production, system downtime, or increased utility costs.
Indemnification
Client agrees to indemnify, defend, and hold harmless SonnyWindows, its owners, employees, and contractors from any claims, damages, losses, or liabilities arising from pre-existing conditions, third-party installations, failure to disclose known issues, or client negligence.
Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by the laws of the state in which the service is performed. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in the state where service occurred.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede all prior discussions, representations, or agreements, whether written or oral.

Gutter Cleaning Terms and Conditions

Assumption of Risk and Waiver of Liability
a. Gutter System Condition
SonnyWindows is not responsible for pre-existing conditions including, but not limited to, sagging gutters, loose or missing fasteners, rust, corrosion, cracked seals, improper slope, detached or damaged downspouts, or prior repairs. These conditions may limit cleaning effectiveness and may result in additional damage during normal service.
b. Water Damage Due to Gutter or Roof Failure
SonnyWindows is not liable for any interior or exterior water damage resulting from clogged, defective, improperly installed, or poorly maintained gutters, downspouts, flashing, roofing, fascia, or drainage systems. Gutter cleaning does not guarantee prevention of future leaks, overflows, or drainage issues.
c. Detached or Compromised Fixtures
Gutters, gutter guards, hangers, seams, or downspouts that become detached, bent, cracked, or collapse during standard cleaning are the responsibility of the homeowner unless direct, provable negligence by SonnyWindows is demonstrated.
d. Ladder-Related Wear or Contact
Minor contact marks, cosmetic indentations, scuffs, or wear to gutter edges, shingles, siding, or trim may occur as part of safe ladder placement and access. SonnyWindows is not liable for minor cosmetic wear resulting from standard ladder usage.
e. Latent or Hidden Defects
SonnyWindows is not responsible for damage caused by latent or hidden defects that were not visible or reasonably discoverable prior to service, including concealed rot, internal gutter failure, hidden fascia damage, or compromised roof edges.
Scope of Work
a. Standard Service
Standard gutter cleaning includes removal of debris from gutters and accessible downspouts, basic flushing where possible, and cleanup of removed material from the immediate work area. A visual inspection of gutter condition, visible clogs, and drainage concerns may be performed; however, this does not constitute a full inspection or diagnosis.
b. Exclusions
Service does not include roof cleaning, underground drain jetting, interior drain clearing, fascia or soffit repair, gutter or downspout reattachment, gutter guard installation or removal, pest or animal nest removal, or structural repairs unless explicitly agreed to in writing prior to service.
c. Obstructions and Access Issues
Clients are responsible for ensuring safe and reasonable access to gutter systems. If access is obstructed or unsafe due to slope, height, landscaping, locked gates, debris, animals, or structural instability, SonnyWindows reserves the right to reschedule, cancel, or partially complete service.
No Guarantee of Performance
SonnyWindows does not guarantee that gutter cleaning will resolve all drainage issues, prevent future clogs, or eliminate water intrusion. Performance depends on gutter design, installation quality, roof conditions, surrounding trees, weather, and ongoing maintenance.

a. 10% Deposit Requirement
All one-time or first-time gutter cleaning services require a 10% non-refundable deposit to reserve a scheduled service date after estimate approval.
b. Deposit Credit Policy
If a client cancels service, the deposit is non-refundable but may be credited toward future services at SonnyWindows’ discretion.
c. Recurring Services
Recurring gutter service clients are billed in advance per scheduled service. If a service is canceled after billing, the amount may be credited toward future services or upgrades.
d. Late Fees
Unpaid balances are subject to a 10% monthly late fee until paid in full.
Damage Caused by SonnyWindows Negligence
In the event of damage caused directly by SonnyWindows’ proven negligence (excluding pre-existing conditions), SonnyWindows will, at its discretion:
Repair the damage, or
Provide reasonable compensation, or
Facilitate an insurance claim if applicable
All damage claims must be reported within 48 hours of service completion.
Client Responsibilities
Clients agree to:
Ensure gutters and work areas are reasonably accessible
Secure pets and remove valuables near work zones
Disclose known structural issues, loose fasteners, disconnected downspouts, or prior repairs
Provide water access if flushing is part of the agreed scope
Failure to disclose known issues may limit or void liability coverage.
Structural Integrity Disclaimer
Client acknowledges that gutters, fascia, roof edges, and supporting structures are structurally sound and capable of supporting standard service access. SonnyWindows is not responsible for failures related to age, improper installation, design flaws, or material deterioration.

Christmas Light Installation Terms and Conditions
Effective Date: 01/01/23
Scope of Work
a. Standard Service
SonnyWindows provides full-service holiday lighting, which may include the purchase, custom cutting and fitting, professional installation, in-season maintenance (such as bulb replacement), and post-season takedown of holiday lights, unless otherwise agreed to in writing.
b. Lights Ownership
All holiday lighting materials supplied by SonnyWindows remain the sole property of SonnyWindows. Clients are paying for rental, installation, maintenance, takedown, and seasonal storage, not ownership. Lights are reclaimed at the end of the season unless a separate written purchase agreement is executed.
c. Customer-Provided Lights
If a client provides their own lights for installation:
SonnyWindows provides installation services only
No maintenance, repair, or replacement is provided for customer-supplied lights
SonnyWindows is not liable for electrical faults, breakage, defects, or premature failure of customer-provided materials
No Guarantee of Appearance or Longevity
While SonnyWindows strives for professional and visually appealing installations, no guarantee is made regarding exact appearance, brightness, color consistency, or longevity of lighting, as results may vary due to weather, product limitations, power supply, or environmental conditions.
Deposits and Payment Terms
a. 50% Payment Requirement
A 50% non-refundable payment is required upfront to secure labor, materials, and scheduling. In some cases, SonnyWindows may require full payment in advance.
b. Payment Balance
Any remaining balance is due upon completion of installation. Additional services, modifications, or separately billed takedown services are due upon completion of the respective service.
c. Cancellation Policy
Payments and deposits are non-refundable. If a client cancels service after payment but before installation, SonnyWindows may, at its discretion, apply a credit toward future services.
Assumption of Risk and Waiver of Liability
a. Structural Attachments
Installations are performed using clips, fasteners, or other non-invasive methods wherever possible. SonnyWindows is not liable for damage related to pre-existing conditions or fragile, aged, brittle, or deteriorated structures, including but not limited to gutters, shingles, fascia, siding, stucco, or trim.
b. Electrical Risks
Client is responsible for ensuring outdoor outlets, extension points, and circuits are in safe, working condition and meet electrical code requirements. SonnyWindows is not liable for outages, surges, tripped breakers, circuit overloads, or damage caused by inadequate or unsafe electrical infrastructure.
c. Latent or Hidden Defects
SonnyWindows is not responsible for damage caused by latent or hidden defects that were not visible or reasonably discoverable prior to installation, including concealed wiring issues, structural weaknesses, or internal electrical failures.
Maintenance and Repairs
a. SonnyWindows-Supplied Lights
If SonnyWindows-supplied lights malfunction during the active holiday season, SonnyWindows will repair or replace them at no cost, provided the issue is not caused by vandalism, extreme weather, power issues, client interference, animals, or third-party tampering.
b. Customer-Provided Lights
No maintenance, troubleshooting, repair, or replacement is provided for customer-supplied lights under any circumstances.
Weather and Safety
Installation, maintenance, or takedown services may be delayed, rescheduled, partially completed, or canceled due to weather conditions, wet or icy surfaces, excessive wind, extreme cold or heat, or any unsafe conditions. SonnyWindows retains sole discretion to determine when services can be safely performed.
Incomplete or Interrupted Services
If services cannot be completed due to safety concerns, weather conditions, access limitations, or undisclosed hazards, SonnyWindows may charge for work performed up to the point of interruption.
Takedown and Seasonal Storage
Takedown is typically scheduled for January, but timing may vary due to weather, safety, or scheduling constraints. After takedown:
All lights and hardware supplied by SonnyWindows remain SonnyWindows property
Materials are securely stored, labeled, and organized for potential reuse the following season
Clients discontinuing service will not receive lights unless a separate purchase agreement is executed
Client Responsibilities
Clients agree to:
Provide clear and safe access to installation areas
Secure pets and remove obstacles near work zones
Disclose known structural, electrical, or access issues prior to service
Avoid tampering with installed lighting
Failure to disclose known issues may limit or void liability coverage.
Authorization to Perform Services
By scheduling service, the client confirms they are the property owner or have authority to authorize holiday light installation and agree to these Terms and Conditions on behalf of the property owner.
Right to Refuse Service
SonnyWindows reserves the right to refuse, discontinue, or terminate service at any time if conditions are deemed unsafe, misleading, or inconsistent with company standards.

Client agrees to indemnify, defend, and hold harmless SonnyWindows, its owners, employees, and contractors from any claims, damages, losses, or liabilities arising from pre-existing conditions, customer-provided materials, electrical infrastructure, failure to disclose known issues, or client negligence.
